Delivery, collection and payment

  • In Lithuania, goods are delivered by the LP Express courier service, and delivery takes 2–3 business days after dispatch. Delivery costs 5 EUR.

  • If you do not want to pay for shipping, you can collect paintings and other goods from our warehouse/shop at Vilkpėdės g. 10 (building 20), Vilnius. Please call beforehand: mobile +370 699 90 607 or tel./fax (+370 5) 2151316.

  • Opening hours: 9:00–17:00 (Monday–Thursday), 9:00–16:00 (Friday).

  • To arrange a visit to our warehouse on a Saturday, please call: +370 699 90 607.

Purchase terms and conditions

1. General provisions

1.1.These rules for the purchase and sale of goods (hereinafter – the Rules) are a legal document binding on the Parties, which sets out the rights, obligations and liability of the Buyer and the Seller when the Buyer purchases goods in the paveikslai.com online store.

1.2.The Seller reserves the right to change, amend or supplement these Rules at any time, taking into account the requirements established by legal acts. The Buyer is informed of any changes on the paveikslai.com online store website. When the Buyer shops in the online store, the Rules in force at the time the order is placed apply.

1.3.The following persons have the right to buy in the online store:

1.3.1.Natural persons with full legal capacity, i.e. persons who have reached the age of majority and whose legal capacity has not been restricted by a court;

1.3.2.Minors aged 14 to 18, only with the consent of their parents or guardians, except where they may independently dispose of their own income;

1.3.3.Legal entities;

1.3.4.Authorised representatives of all the persons listed above.

1.4.By approving the Rules, the Seller also guarantees that, in accordance with clause 1.3 of the Rules, the Buyer has the right to buy goods in the paveikslai.com online store.

1.5.The contract between the Buyer and the Seller is deemed concluded from the moment when the Buyer, having filled a shopping cart in the paveikslai.com online store, specified the delivery address, chosen the payment method and read the Seller's Rules, clicks the “Confirm order” button (see clause 5 “Ordering of goods, prices, payment procedure, terms”).

1.6.Each contract concluded between the Buyer and the Seller is stored in the paveikslai.com database and also, in paper form, in the company's e-commerce department.

2. Privacy policy and personal data protection

2.1.The Buyer may order goods in the paveikslai.com online store:

2.1.1.By registering in the paveikslai.com online store – entering the data requested during registration;

2.1.2.Without registering in the paveikslai.com online store.

2.2.When ordering goods in the ways provided for in clause 2.1 of the Rules, the Buyer must provide, in the relevant information fields provided by the Seller, the Buyer's personal data necessary for the proper fulfilment of the order: first name, last name, exact delivery address, telephone number and e-mail address.

2.3.By accepting these Rules, the Buyer agrees that the Buyer's personal data provided under clause 2.2 will be processed for the purposes of selling goods/services in the paveikslai.com online store, analysing the Seller's activities and direct marketing.

2.4.By agreeing that the Buyer's personal data will be processed for the purpose of selling goods/services in the Seller's online store, the Buyer also agrees that informational messages necessary to fulfil the order will be sent to the e-mail address and telephone number provided by the Buyer.

2.5.When registering in the paveikslai.com online store and ordering goods, the Buyer undertakes to keep their login details safe and not to disclose them to anyone.

2.6.The Buyer agrees that the personal data they voluntarily provide in the registration form will be processed in accordance with these Rules.

2.7.The Buyer has the right to access their personal data and to request that incorrect, incomplete or inaccurate personal data be corrected, blocked or deleted by writing to info@paveikslai.com or calling +370 656 12122. In such a case, the Seller must fulfil the Buyer's request without delay and no later than within 2 business days.

2.8.The Buyer has the right to receive information on the sources from which their personal data has been collected and what data has been collected, the purpose for which it is processed, and the data recipients to whom it is provided and has been provided during at least the last year.

2.9.The Buyer has the right to request the correction or destruction of their personal data, or the suspension of processing operations of their personal data (except storage), where the data is processed in breach of the law.

2.10.The data controller recognises and respects the right to privacy of every Buyer who registers in the paveikslai.com online store. The data controller collects and uses the Buyer's personal data (company name or first and last name, address, telephone number, e-mail address and other information provided in the online store registration form) to process orders for goods or services or to perform other contractual obligations. By placing an order or registering, the customer agrees to the rules for the purchase and sale of goods, clause 2.3 of which states that by accepting these Rules the Buyer agrees that the personal data provided by the Buyer will be processed for the purposes of selling goods and services in the paveikslai.com online store, analysing the Seller's activities and direct marketing. This also includes sending advertising and informational messages: by registering, the Buyer agrees to receive newsletters and similar material, which the Buyer has every right to opt out of.

2.11.The data controller undertakes not to disclose the Buyer's personal data to third parties, except for the data controller's partners providing delivery or other services related to the proper fulfilment of the Buyer's order. In all other cases, the Buyer's personal data may be disclosed to third parties only in accordance with the procedure established by the legal acts of the Republic of Lithuania.

2.12.Personal data is processed using secure means that protect it from unlawful destruction, disclosure or other unlawful actions.

2.13.The personal data of persons who have consented to the use of their data for direct marketing purposes is stored in an active database and used for direct marketing purposes for 2 years. The Buyer's data is stored for 2 years from the last purchase. After this period, the customer's data is (automatically) destroyed. The automatic destruction of personal data is supervised by a responsible person.

3. Rights and obligations of the Buyer

3.1.The Buyer has the right to buy goods in the paveikslai.com online store in accordance with the procedure set out in these Rules and in other information sections of the paveikslai.com online store.

3.2.The Buyer has the right to withdraw from the contract for the purchase and sale of goods with the paveikslai.com online store by notifying the Seller in accordance with the instructions in clause 8 of these Rules (return of goods and money) no later than within 14 (fourteen) business days from the day the item was delivered, except where the contract cannot be withdrawn from under the laws of the Republic of Lithuania (see the website of the public institution “Vartotojų centras” https://www.vartotojucentras.lt/istatymas.php?id=1038, “Specifics of the return and exchange of non-food goods”, clause 18).

3.3.The Buyer may exercise the right provided for in clause 3.2 of the Rules only if the item has not been damaged, its appearance has not changed significantly, and it has not been used.

3.4.The Buyer undertakes to accept the ordered goods and pay the agreed price for them.

3.5.If the data provided in the Buyer's registration form changes, the Buyer must update it without delay.

3.6.The Buyer undertakes not to pass their login details to third parties. If the Buyer loses their login details, they must immediately inform the Seller using the means of communication listed in the “Contacts” section (by phone/e-mail).

3.7.By using the paveikslai.com online store, the Buyer agrees to these Rules of purchase and sale and undertakes to comply with them and not to violate the legal acts of the Republic of Lithuania.

4. Rights and obligations of the Seller

4.1.The Seller undertakes to create all conditions for the Buyer to properly use the services provided by the paveikslai.com online store.

4.2.If the Buyer attempts to harm the stability and security of the Seller's paveikslai.com online store or breaches their obligations, the Seller has the right, immediately and without warning, to restrict or suspend the Buyer's access to the online store or, in exceptional cases, to cancel the Buyer's registration.

4.3.The Seller undertakes to respect the Buyer's right to privacy of the Buyer's personal information provided in the paveikslai.com online store registration form.

4.4.The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer.

5. Ordering of goods, prices, payment procedure and terms

5.1.The Buyer can shop in the paveikslai.com online store 24 hours a day, 7 days a week, unless the online store is unavailable due to technical maintenance.

5.2.The contract enters into force from the moment the Buyer clicks the “Confirm order” button and the Seller, having received the order, confirms it by sending a confirmation e-mail to the e-mail address provided by the Buyer.

5.3.Prices of goods in the paveikslai.com online store and in the order are stated in euros, including VAT.

5.4.The Buyer pays for goods in one of the following ways:

5.4.1.Advance payment using a pre-filled form, by bank transfer via the secure PAYSERA payment system – by selecting the logo of your bank from those shown in the payment window, you will pay without entering any additional data. After selecting such a link, the customer is redirected to their bank's system, where it is enough to log in and confirm the payment of the final amount calculated in the order for the selected goods. The order form is filled in automatically, and the Seller is informed of the successful payment immediately, regardless of the online banking system used and/or the time of day. This speeds up the preparation, dispatch and delivery of goods. Lower transfer fees apply when paying via the PAYSERA payment system. All terms, privileges and rules of the intermediary PAYSERA apply to a customer paying by this method.

5.4.2.Payment by ordinary bank transfer – this is advance payment, where the Buyer makes a local payment transfer directly to the UAB VILOGA PAYSERA bank account. The payment details are provided before the order is confirmed and are also shown on the pro forma invoice and the VAT invoice. A customer who does not use online banking can print the invoice and make the transfer at their bank branch. In the “Payment purpose” field of the payment form, the Buyer must state the order number given in the order confirmation e-mail. Bank fees for transferring money to the UAB VILOGA PAYSERA account are not included in the customer's invoice for the goods. The Seller is not responsible for the application and/or amount of such fees. Before making a bank transfer, make sure that you have confirmed the order and received an e-mail confirming it; otherwise the order is not registered in the system. Attention! When paying this way, funds are credited only in accordance with the standard procedure of your online banking provider (your bank), and transfers are credited only at certain intervals on certain days. A customer paying this way must be familiar with the duration and accuracy of money transfers under the terms of their bank; in this case the Seller is not responsible for how long it takes for the funds to be credited, and fulfilment of the order begins only once the funds have reached the UAB VILOGA PAYSERA bank account.

5.4.3.Cash payment to the courier on delivery – if at the time of ordering the Buyer chooses delivery by courier, payment can also be made when receiving the goods, to the courier handing them over. This service costs paveikslai.com extra and is included in the customer's invoice.

5.4.4.Card payment to the courier on delivery – if at the time of ordering the Buyer chooses delivery by courier, payment can also be made by bank card when receiving the goods. This service costs paveikslai.com extra and is included in the customer's invoice.

5.5.A Buyer who has chosen payment by bank transfer undertakes to pay for the goods without delay, as the parcel is prepared and the dispatch period starts only once payment for the goods has been received.

5.6.The Seller issues the Buyer an electronic invoice; the pro forma invoice is sent to the specified e-mail address immediately after the order is confirmed. The final invoice is issued after payment; a paper copy of this invoice is handed over together with the goods, and an electronic copy is sent by e-mail or together with the goods.

6. Delivery of goods

6.1.A Buyer whose payment for products exceeds 60 euros is entitled to free delivery of the goods to the address they specify.

6.1.2.The price of standard delivery (painting, key box) is 5 EUR. This type of delivery was chosen because most goods are of non-standard size (they cannot be sent via parcel lockers). Delivery is made to the address specified by the Buyer anywhere in Lithuania.

6.2.A Buyer who chooses the delivery service when ordering undertakes to specify the exact delivery location.

6.3.The Buyer undertakes to accept the goods personally. If the Buyer cannot accept the goods personally and the goods are delivered to the specified address, the Buyer has no right to make claims against the Seller regarding delivery of the goods to the wrong person.

6.4.All goods are delivered by the LP Express courier service to the address specified in your order information.

6.5.For your convenience, parcels are delivered to customers on business days in three time slots.

6.5.1.If the customer wishes to receive the goods urgently, the customer must contact the Seller and discuss additional delivery options. To receive the goods in other ways, please contact customer service: paveikslai.com “CONTACTS”.

6.6.It is not possible to ask the courier to deliver the order at a specific time (except where the Buyer makes a separate arrangement with the Seller regarding delivery in accordance with clause 6.5.1 of these Rules).

6.7.The estimated delivery time is 2–3 business days after payment is received.

6.8.The Seller delivers goods to the Buyer within 2–3 business days. These periods are indicative and, moreover, do not apply where the required goods are not in the Seller's warehouse and the Buyer is informed of the shortage of the ordered goods. The Buyer also agrees that, in exceptional cases, delivery of the goods may be delayed due to unforeseen circumstances beyond the Seller's control. In such a case, the Seller undertakes to contact the Buyer without delay and agree on the delivery terms.

6.8.1.Goods in the Seller's warehouse are delivered to the Buyer anywhere in Lithuania within 2–3 business days after payment for the order. Once the goods have been dispatched, the Buyer is notified by an automatic e-mail.

6.8.2.If an order is placed before 15:00 on a business day but is paid later by bank transfer or via the PAYSERA direct payment system, dispatch of the order is moved to the next business day and the delivery date is postponed by two business days.

6.8.4.Any payment for an order made after 15:00 on a business day, or at any time on a non-business day, moves dispatch of the order to the next business day.

6.9.When goods are delivered from warehouses in foreign countries, delivery may take about 20–30 business days.

6.10.If an item is delivered under an individual order, individually agreed delivery times apply, but the maximum delivery time does not exceed 3–4 weeks. Delivery times for individual goods may differ. The estimated delivery time is shown on each product page.

6.11.Ordered goods are always delivered in a single shipment, and the Buyer is informed individually about different delivery times for different goods. Several ordered goods may be delivered in separate shipments at the customer's request for an additional standard delivery fee in accordance with clause 6 of these Rules.

6.12.In all cases, the Seller is released from liability for breach of delivery deadlines if the goods are not delivered to the Buyer, or are delivered late, through the fault of the Buyer or due to circumstances beyond the Seller's control.

6.13.On delivery, you must check the external condition of the parcel while the courier is still present. If you notice even the slightest damage to the parcel, you must record comments about the damage or refuse to accept the parcel.

6.14.Once the parcel has been accepted and the manifest signed without comments, the parcel is deemed to have been delivered in good condition, and claims regarding external damage to the goods will no longer be accepted. In any case, the warranty obligations for the goods remain in force.

6.15.In all cases, the Buyer must inform the Seller without delay if the parcel is delivered in damaged packaging, if it contains goods that were not ordered or the wrong quantity of goods, or if the goods are incomplete.

6.16.In all cases, a Buyer who notices damage to the packaging on delivery must note it in the delivery document provided by the courier or draw up a separate report on the damage. The Buyer must do this while the courier is present. If this is not done, the Seller is released from liability to the Buyer for damage to the goods related to packaging damage that the Buyer did not note in the courier's delivery document.

6.17.For delivery of goods outside Lithuania, please contact us by e-mail at info@paveikslai.com, and we will write to you personally about the delivery terms and price.

6.18.An additional fee applies, without exception, to deliveries to the Curonian Spit. When delivering a parcel to the Curonian Spit, we will contact you personally.

7. Quality of goods and warranties, warranty service

7.1.The details of each item sold in the paveikslai.com online store are given in the description accompanying that item.

7.2.The Seller is not responsible if the colour, shape or other parameters of goods shown in the online store do not match the actual size, shape and colour of the goods due to the characteristics of the Buyer's display.

7.3.The customer always has the right to contact info@paveikslai.com, and we will do our best to provide prompt assistance or the necessary information regarding the return or exchange of an item. When contacting us, please state the order number, purchase date, and the buyer's first and last name or company name.

7.4.If an item is defective, you can return or exchange it within 14 calendar days from the date of purchase (receipt of the item) in accordance with section 8 of these Rules.

8. Return and exchange of goods and/or refunds

If you wish to cancel an order whose goods you have not yet received, or to withdraw from particular item(s) of an order that has been paid for but not yet fulfilled, and get your money back, please let us know as soon as possible by e-mail: info@paveikslai.com. Otherwise, please follow the rules below:

8.1.Defects of goods sold are remedied, and defective goods are exchanged or returned, in accordance with the Rules for the Return and Exchange of Goods approved by Order No. 217 of the Minister of Economy of the Republic of Lithuania of 29 June 2001 “On the approval of the Rules for the Return and Exchange of Goods”, except where the contract cannot be withdrawn from under the laws of the Republic of Lithuania (where the contract concerns the sale of hygiene goods – bedding; more information on the website of the public institution “Vartotojų centras” https://www.vartotojucentras.lt/istatymas.php?id=1038, “Specifics of the return and exchange of non-food goods”, clause 18). Money for returned goods is in all cases transferred only to the payer's bank account.

8.2.A Buyer wishing to return item(s) under clause 8.1 of the Rules may do so within 14 (fourteen) calendar days from the day the goods were delivered to the Buyer, by completing and sending the Seller a free-form request, which must contain true and valid details. The subject of the e-mail must state “Return of goods” and your four-digit order number, e.g.: Return of goods 1234. The order number is shown on the invoice and in e-mails related to the order.

8.2.3.Money is refunded to the bank account no later than within 14 business days, counting from the day the goods are received back at the warehouse.

8.2.4.Return and/or exchange of defective goods is free of charge. Goods of proper quality are returned at the Buyer's expense. Returned goods are collected by a courier ordered by paveikslai.com. The condition of returned goods is checked by the warranty service; if the returned goods are of proper quality, the standard delivery fee within Lithuania (5 EUR) is deducted from the refund.

8.3.When returning goods, the Buyer must comply with the following conditions:

8.3.1.The returned item must be in its original, intact packaging;

8.3.2.The item must not have been damaged by the Buyer;

8.3.3.The item must be unused and must not have lost its commercial appearance (labels intact, protective films not removed, etc.) (this clause does not apply when a defective item is returned);

8.3.4.The returned item must be as complete as when the Buyer received it;

8.3.5.When returning an item, its proof of purchase must be provided.

8.4.The Seller has the right to refuse goods returned by the Buyer if the Buyer does not follow the return procedure set out in clause 8.3.

8.5.When a wrong item and/or a defective item is returned, the Seller undertakes to take back such goods and replace them with equivalent suitable goods.

8.6.If the Seller has no suitable replacement goods, the amount paid, excluding the delivery price, is refunded to the Buyer within 14 business days.

8.7.Paveikslai.com has the unilateral right to deduct the amount of an additional discount granted from the amount refunded to the customer if the customer used an additional offer discount and later cancelled (returned) at least one item of proper quality from the offer to which the discount was applied.

8.8.Where the reason for returning an item is poor quality, paveikslai.com undertakes, at its own expense, to replace the defective item with one of proper quality or to refund the money paid for the item. Defective goods are exchanged or refunded in accordance with the “Rules for the Return and Exchange of Goods” approved by Order No. 217 of the Minister of Economy of 29 June 2001.

8.10.IMPORTANT! The return procedure does not apply to: legal entities; products with individual modifications made at the customer's request or under individual orders that irreversibly alter their original commercial appearance; individually ordered goods (paintings painted to order); goods damaged by the customer; goods that do not meet the return standards listed above (damaged commercial appearance, signs of use or wear); goods returned after the 14-day return period. An exception applies to goods that do not meet the return requirements but are defective.

9. Liability of the Buyer and the Seller

9.1.The Buyer is fully responsible for the accuracy of the personal data they provide. If the Buyer does not provide accurate personal data in the registration form, the Seller is not responsible for the resulting consequences and acquires the right to claim compensation from the Buyer for the direct losses incurred.

9.2.The Buyer is responsible for actions performed using the paveikslai.com online store.

9.3.A registered Buyer is responsible for passing their login details to third parties. If the services of the paveikslai.com online store are used by a third party who has logged in using the Buyer's login details, the Seller considers that person to be the Buyer.

9.4.The Seller is released from any liability where losses arise because the Buyer, disregarding the Seller's recommendations and the Buyer's own obligations, did not read these Rules even though they were given the opportunity to do so.

9.5.If the Seller's online store contains links to websites of other companies, institutions, organisations or persons, the Seller is not responsible for the information on them or the activities carried out, does not maintain or control those websites, and does not represent those companies and persons.

9.6.In the event of damage, the Party at fault compensates the other Party for direct losses.

10. Marketing and information

10.1.The Seller may, at its discretion, run various promotions in the online store.

10.2.The Seller has the right to unilaterally, without separate notice, change the terms of promotions or cancel them. Any change or cancellation of the terms and procedure of promotions applies only going forward, i.e. from the moment it is made.

10.3.The Seller sends all notices using the contact details provided in the Buyer's registration form.

10.4.The Buyer sends all notices and questions to the telephone numbers or e-mail addresses listed in the “Contacts” section of the Seller's online store.

10.5.The Seller is not responsible if the Buyer does not receive informational or confirmation messages due to disruptions in the internet connection or in the networks of e-mail service providers.

11. Final provisions

11.1.These Rules for the purchase and sale of goods have been drawn up in accordance with the laws and legal acts of the Republic of Lithuania.

11.2.All disagreements arising from the implementation of these Rules are resolved through negotiation. If no agreement is reached, disputes are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
